Access and use of the Service is subject to the following Terms and Conditions of Service ("Terms and Conditions"). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. Bunch may amend, update or change these Terms and Conditions. If we do this, we will post the changes on this page and indicate at the top of this page the date these Terms and Conditions were last revised. Any changes will be effective immediately. Your continued use of the Website after the date any such changes become effective constitutes your acceptance of the new Terms and Conditions.

Description of Service
The Service allows users to consume Financial Literacy course curated by seasoned trainers. Bunch may, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently.
Registration
In connection with registering for and using the Service, you agree (i) to provide accurate, current and complete information about you and/or your organization as requested by Bunch; (ii) to maintain the confidentiality of your password and other information related to the security of your account; (iii) to maintain and promptly update any registration information you provide to Bunch while registering or during your usage of Bunch's services, to keep such information accurate, current and complete; (iv) to be fully responsible for all use of your account and for any actions that take place through your account; (v) by signing up on Bunch you deemed to have given your consent to be contacted by us via phone calls, e-mails and/or SMS notifications and offer you our services, imparting product knowledge, offer promotional offers running on website/app, offers offered by the associated third parties and also order/shipment/delivery related updates. You authorize Bunch to give you a call for the above mentioned purposes. irrespective of the fact that you have registered yourself under DND or DNC or NCPR service.
Subscriptions
You may choose to purchase a monthly or annual subscription and download the Application through a third party platform. Alternatively, you may subscribe to our Services through our website and then download the related Application through a third party platform.
When you purchase a subscription, payment may be processed by third parties who act on our behalf or directly by the third party platform (e.g. Apple or Google). Rates for services are listed in the Application and in the applicable app store. Bunch reserves the right to modify its rates at any time and/or to offer special promotions. All payments are non-refundable. Subscription payments will auto-renew unless cancelled in accordance with the Terms and Conditions. If you purchased the Application through a third party platform and have a billing dispute, you must contact the respective third party platform to seek a remedy. If you purchased a subscription to our Services through our Website or Application, please contact us at queries@classplus.co.
Your Representations and Warranties
You represent and warrant to Bunch that your access and use of the Service will be in accordance with these Terms and Conditions and with all applicable laws, rules and regulations of India and any other relevant jurisdiction, including those regarding online conduct or acceptable content, and those regarding the transmission of data or information exported from India and/or the jurisdiction in which you reside.
Inappropriate Use
You will not upload, display or otherwise provide on or through the Service any content that: (i) is libelous, defamatory, abusive, threatening, harassing, hateful, offensive or otherwise violates any law or infringes upon the right of any third party (including copyright, trademark, privacy, publicity or other personal or proprietary rights); or (ii) in Bunch's sole judgment, is objectionable or which restricts or inhibits any other person from using the Service or which may expose Bunch or its users to any harm or liability of any kind.
You shall not use the Services in any manner that could damage, disable, overburden, or impair our server, or any network(s) connected to any other server, or interfere with any other party's use and enjoyment of the Services. You shall not attempt to gain unauthorized access to any functions and features, other user accounts, computer systems or networks connected to any other server, in any manner, including, through hacking, password mining or any other means. You shall not obtain or attempt to obtain any materials or information through any means which is not specifically made available to your user account or through the Services.
The Services are made available to you on a non-exclusive, non-transferable, non-sublicensable and on a limited license basis for your own personal and non-commercial use alone and grant you a limited right to access the material on the Website or Application. Nothing in these Terms and Conditions shall grant the user or any other person any right to access or use the source code or constitute any license of the source code. You shall not, by yourself or through any third parties:

Bunch and its suppliers make no representations or warranties of any kind with respect to the Service, either express or implied, and all such representations and warranties, including warranties of merchantability, fitness for a particular purpose or non-infringement, are expressly disclaimed. Without limiting the generality of the foregoing, Bunch does not make any representation or warranty of any kind relating to accuracy, service availability, completeness, informational content, error-free operation, results to be obtained from use, or non-infringement. Access and use of the service may be unavailable during periods of peak demand, system upgrades, malfunctions or scheduled or unscheduled maintenance or for other reasons. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
Under no circumstances will Bunch be liable in any way for use of any Bunch Services or any other information, data, or other material downloaded or otherwise obtained through or from the Website or Application, including any errors or omissions, or any loss or damage or defamation of any kind incurred as a result of your use of or reliance on such information or data. No advice or information, whether oral or written, obtained by the user from Bunch or through or from the Services or Website or Application, shall create any warranty by Bunch.
Testimonials, reviews and success stories including but not limited to regarding hike in salary, promotions, etc. if appearing on the Website or Application are individual experiences, reflecting real-life experiences of those that have used our Services in some way or another. However, they are individual results and results may vary. We do not claim that they are typical results that consumers will generally achieve. The testimonials are not necessarily representative of all of those who will use our Services.
Limitation of Liability
Neither Bunch nor any of its affiliates, employees, directors, officers, shareholders, agents, representatives, vendors or suppliers shall be liable to you or any other person, whether in tort, contract, strict liability or otherwise, for any indirect, special, incidental or consequential losses or damages of any nature arising out of or in connection with the use or inability to use the Services, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of search results, or computer / electronic device failure, virus or malfunction. In no event shall Bunch be liable for any damages in excess of the fees paid by you in connection with your Service.


Termination
You agree that Bunch, in its sole discretion, may deactivate your account or otherwise terminate your use of the Website or Application or enrolment to a Service with or without reason, including, without limitation, if Bunch believes that you have (a) breached the Terms and Conditions; (b) infringed the intellectual property rights of a third party; or (c) violated or acted inconsistently with the letter or spirit of these Terms and Conditions or any other applicable code of conduct. You agree that any deactivation or termination of your access to the Services may be effected without prior notice to you and that Bunch shall not be liable to you nor any third party for any termination of your account or enrolment into a Service. You also acknowledge that Bunch may retain and store your information on Bunch’s systems notwithstanding any termination of your account or enrolment into the Services.


Proprietary Rights in Service Content and Activity Data
All content available through the Service, including designs, text, graphics, images, information, software, audio, e-books, and other files, and their selection and arrangement (the "Service Content") along with printed version of e-books, are the proprietary property of Bunch or its licensors. No Service Content along with printed version of e-books may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms and Conditions. You may not use any data mining, robots, scraping or similar data gathering or extraction methods to obtain Service Content. As between you and Bunch, all data and information generated from your access and use of the educational activities made available on or through the Service, including translated content generated by you (collectively, the "Activity Data"), shall be exclusively owned by Bunch, and you shall not have any right to use such Activity Data except as expressly authorized by these Terms and Conditions. Activity Data will not include material you submit for translation or any resulting translation. By using the Service, you hereby assign to Bunch any and all rights, title and interest, including any intellectual property rights or proprietary rights, in the Activity Data. All rights of Bunch or its licensors that are not expressly granted in these Terms and Conditions are reserved to Bunch and its licensors.
Trademarks
"Bunch" and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or service marks of Bunch or their respective owners. Access and use of the Service does not grant or provide you with the right or license to reproduce or otherwise use the Bunch name or any Bunch or third-party trademarks, service marks, graphics or logos.
Privacy
Use of the Service is also governed by our Privacy Policy, a copy of which is located here. By using the Service, you consent to the terms of the Privacy Policy.
Cancellation Policy
No cancellations are allowed for products on which Bunch marketing team has given special offers for various purposes including but not limited to special occasions like New Year, festivals, specific examination etc. These are limited validity offers and therefore cancellations are not possible.
Refund Policy
The refund is applicable for our products/services only until it’s dispatched or the login details for online access to test material etc. are disclosed/dispatched to you.
Please include your order number (sent to you via email after your order) and do tell us why you’re requesting a refund. We take customer feedback very seriously and use it to constantly improve our products and quality of service.
All refunds, if eligible, will be processed within 14 (Fourteen) business days of receiving cancellation request and mode of refund would be same through which the original transaction was done.
Third-Party Intellectual Property
Bunch respects third-party intellectual property rights and actively supports protection of all third-party intellectual property including copyrights and trademarks (“IP”). It is our policy to expeditiously respond to clear notices of alleged IP infringement. If we receive proper notification of IP infringement, our response to such notices will include removing or disabling access to material claimed to be the subject of infringing activity.
If you believe that your product or other work has been misrepresented or used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide us with the following information:

It is hereby stated Bunch shall in no way be responsible for any acts or omissions of third parties. Any transaction, dealings, or communication otherwise that the user may have with such third parties are at the user’s own risk and we make no warranties, express or implied regarding the quality or suitability of the services or products of such third-party vendors. You may be redirected to a third-party website upon clicking on such links, these websites will be governed by Third Party Policies. Bunch shall not be responsible for any transaction or dissemination of information that may take place while accessing these third-party websites. You acknowledge and agree that Bunch is not responsible or liable for any loss or damage of any kind incurred because of any such dealings with such third parties. Any use you make of any site or service linked to by the Platform is entirely at your own risk.

Bunch uses third parties to assist in providing Services to You. You acknowledge that when you avail these third-party services, Third Party Policies shall apply. The Third Party Policies may be amended from time to time and the user shall bear the responsibility of being appraised of such amendments. Bunch shall not intimate the user of any such amendments.

User Guidelines
In consideration of Bunch granting you the rights hereunder, you hereby agree to only use Vector Platform for facilitating education and not for any purpose that is unlawful under any applicable laws and/or in violation of the Terms and Conditions. You shall not use the Vector Platform in any manner that could damage, disable, overburden, or impair any network(s) connected to any server, or interfere with any other party's use and enjoyment of the Vector Platform and. You shall not attempt to gain unauthorized access to any functions and features, other user accounts, computer systems or networks connected to any other server, in any manner, including, through hacking, data or password mining or any other means. You shall not obtain or attempt to obtain or extract any materials, data or information through robots or any means which is not intentionally made available to your Account or through the Vector Platform.

The Vector Platforms are made available to you on non-exclusive, non-transferable, non-sublicensable and on limited license basis for your own personal and non-commercial use alone and grants you a limited right to temporarily download one copy of the material (information or software) on the Vector Platform. Nothing in these Terms and Conditions shall grant the user or any other person any right to access or use the source code or constitute any license of the source code. You shall not allow third parties to:

make and/or distribute copies of the Vector Platform or any deliverable generated by the Vector Platform;
attempt to copy, reproduce, alter, modify and/or reverse engineer the Vector Platform and/or
create derivative works of the Vector Platform.

You accept that all operations emanating from your Device shall be assumed to have been initiated by you.

You shall not use the Vector Platform to transmit, distribute, send, etc. viruses, worms, or any other code that may be deemed dangerous, harmful, or destructive in any manner.

You shall not copy, reproduce, distribute, or create derivative works or modify the Content that is available on the Vector Platform. Also, you shall not attempt to decompile or reverse engineer or reverse compile our technology/ software that is available on the Vector Platform or transfer the material to another person or “mirror” the material on any other server, including, without limitation, such Java applet, as may be associated with the Vector Platform from time to time.

You shall not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods.

You shall request Bunch to block the Account and change the password immediately for the Account, if your Device has been lost or stolen.

You are responsible for any and all activities that occur in your Account. You agree to notify Bunch immediately of any unauthorized use of the Account or any other breach of security. Bunch shall not be liable for any loss to you or your organization owing to negligent actions or a failure on your part to inform Bunch within a reasonable time, about loss or theft of your Device and/or any unauthorized access in your Account, either with or without your knowledge.

You shall be liable for losses incurred by Bunch or any other party due to a third party’s use of the Account. You shall not use any other person’s account at any time, without the permission of the Account holder and Bunch.

Bunch shall make all reasonable efforts to ensure that your information is kept confidential. However, Bunch shall not be responsible for any disclosure or leakage of confidential information and/or loss or damage of the Device due to theft, negligence or failure on your part to practice safe computing.

You shall ensure that while using the functions and features, all prevailing and applicable laws, rules and regulations, shall at all times, be strictly complied with by you and Bunch shall not be liable in any manner whatsoever for default of any nature, by you, regarding the same.

You understand and acknowledge that upon using the Vector Platform, you authorize us to access third-party sites designated by you, on your behalf, to retrieve such information requested by you, and to register for accounts requested by you. For all purposes hereof, you hereby grant us a limited powers and hereby authorize us with the full power of substitution and re-substitution, for you and in your name, place and stead, in any and all capacities, to access third party internet sites, servers or documents, retrieve information, and use your information, all as described above, with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with services and facilities available on the Vector Platform, as fully to all intents and purposes as you might or could do in person. You acknowledge and agree that when we access and retrieve information from third party sites, we are acting as your agent, and not the agent or on behalf of the third party. You agree that such third parties shall be entitled to rely on the foregoing authorization, agency granted by you.

Bunch provides a platform to avail courses online. To keep Bunch running smoothly for all of our users, you agree that you will use the Service only in a manner consistent with the following acceptable use policy (“Acceptable Use Policy”)
You agree not to post any content that:
is sexually explicit or pornographic;
creates a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to yourself, to any other person, or to any animal;
may create a risk of any other loss or damage to any person or property;
seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
violates, or encourages any conduct that violates laws or regulations;
contains any information or content that is reasonably deemed to be hateful, violent, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable;

Attempt to access or search the Services, user content or Bunch content or scrape or download user content or Bunch content from the Services, or otherwise use, upload content to, or create new links, re-posts, or referrals in the Service through the use of any engine, software, tool, agent, device or mechanism (including automated scripts, spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Bunch or other generally available third party web browsers;
Send any unsolicited or unauthorized spam and spam comments on posts, advertising messages, promotional materials, email, junk mail, chain letters or other form of solicitation;
Use any meta tags or other hidden text or metadata utilizing a Bunch or Bunch trademark, logo, URL, or product name without Bunch's express written consent;
Use the Service for any commercial purpose or the benefit of any third party, except as otherwise explicitly permitted for you by Bunch or in any manner not permitted by the Terms;
Use Bunch user information to forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive or false source-identifying information;
Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services;
Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
Collect or store any personally identifiable information from the Services from other users of the Services without their express permission;
Impersonate or misrepresent your affiliation with any person or entity;
Violate any applicable law or regulation;
Request, collect or store username, password, token or any other account authentication information from other users; or
Encourage or enable any other individual to do any of the activities prohibited in this Acceptable Use Policy.
Share your account credentials with your friend/relative or anyone else in order study from a common account.
Bunch reserves the right, but is not obligated, to remove any user content for any reason or for no reason, including user content that Bunch believes violates this Acceptable Use Policy and/or its Terms and Conditions. Bunch may also permanently or temporarily terminate or suspend a user account without notice and liability for any reason, including if, in Bunch's sole determination, a user violates any provision of this Acceptable Use Policy, our Terms and Conditions, or for no reason.
Governing Law and Arbitration
These Terms and Conditions shall be governed by, construed and enforced in accordance with the laws in India. You agree that any legal action, lawsuit or other action brought by Bunch, you or any third party to enforce these Terms and Conditions, or in connection with any matters related to the Services, shall, subject to the arbitration process set out in this clause, be submitted only to the exclusive jurisdiction of the courts of New Delhi. Where a dispute arises, the parties involved shall make all reasonable efforts to resolve the dispute through good-faith negotiations. If efforts to amicably resolve any dispute or claim between the parties are unsuccessful within 30 working days from the date of such written notice initiating the dispute, then such dispute or claim arising out of or in connection with the Terms and Conditions, including any question regarding its existence, validity or termination, shall be referred to an arbitral tribunal comprising of 3 (three) arbitrators, wherein each party shall appoint one arbitrator and the third arbitrator shall be appointed by the aforesaid two arbitrators. All proceedings in any such arbitration shall be conducted in English. The Arbitration shall be governed by Arbitration and Conciliation Act, 1996 or any other law relating to arbitration in force in India at the relevant time. The seat and venue for arbitration shall be New Delhi. The parties to the dispute shall share the costs equally or in proportion as decided by the arbitrator/ arbitral tribunal. The award rendered by the arbitrator shall be final and conclusive on both the parties, whether or not, despite notice, such parties have taken part in the arbitration, and shall be subject to forced execution in any court of competent jurisdiction.


Miscellaneous
If any provision of the Terms and Conditions is found to be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from the other provisions herein and shall not affect the validity and enforceability of any remaining provisions. Bunch shall have no liability under these Terms and Conditions, to the extent arising from any failure of Bunch to perform any of its obligations under these Terms and Conditions, due to any fire, flood, earthquakes, other acts of God, war, civil unrest, terrorism, epidemic, pandemic, internet failures, governmental act or court order, national emergency, strikes or labour disputes or any other event not within Bunch's reasonable control. Bunch shall not be responsible for damage or other problems caused by any unauthorised change to these Terms and Conditions made by way of hacking or cracking this page. The failure of Bunch to exercise or enforce any right or provision of the Terms and Conditions, shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, to the extent that may lawfully be done, and the other provisions of these Terms and Conditions shall remain in full force and effect.
By accepting these Terms and Conditions through your access or use of the Website or Application, you certify that you are 18 years of age or older. To register for the Services, you must meet the Age Requirements specified hereinbelow. If you are a ‘Minor’ or ‘Child’, i.e., an individual who does not meet the Age Requirements, then you may not register for the Services, and only your parent can register on your behalf, agree to all website Terms & Conditions as well as Privacy Policy and enable access to you under their guidance and supervision.
While some of our services may require the collection of a Minor or Child’s personal information, we do not knowingly collect such personal information. In the event a Minor or Child utilizes the Services, it is assumed that he/she has obtained the consent of the parent/legal guardian, and such use is made available by the parents or legal guardian.
Bunch will not be responsible for any consequences that arise as a result of misuse of our Services, that may occur by virtue of any person including a Minor or Child registering for the Services. Bunch reserves the right to terminate your subscription and/or to refuse to provide you with access to the Services if it is discovered that you do not meet the Age Requirements and the consent to use the Services is not given by your parent / legal guardian. We will also take the necessary steps to remove such information from our servers.

Age Requirements to register and use the Services (“Age Requirements”)
If you are a resident of India, then you must have attained at least eighteen (18) years of age, to register and use the Services, or else act under parental consent.
If you are a resident of Australia, then you must have attained at least eighteen (18) years of age, to register and use the Services, or else act under parental consent.
If you are a resident of Singapore, then you must have attained at least thirteen (13) years of age to register and use the Services, or else act under parental consent.
If you are a resident of South Korea, then you must have attained at least fourteen (14) years of age to register and use the Services, or else act under parental consent.
If you are a resident of Vietnam, then you must have attained at least sixteen (16) years of age to register and use the Services, or else act under parental consent.
These Terms and Conditions constitute the entire agreement between you and Bunch relating to the matters set forth herein, and shall not be modified except in writing, as posted on the Website or Application by Bunch or specifically through writing between you and Bunch.
Bunch may freely transfer or assign any portion of its rights or delegate its obligations under these Terms and Conditions. You may not transfer or assign, by operation of law or otherwise, any portion of your rights or delegate your obligations under these Terms and Conditions, without the prior written consent of Bunch, and any such attempted transfer or assignment shall be void and of no effect.
In the event that you feel that your concern has not been resolved to your satisfaction, you may contact our Grievance Officer, who shall endeavor to redress the concern within 30 working days from the date of escalation. You are advised to escalate to the grievance officer only when you have already raised your complaint which has not been resolved to your satisfaction, or your concern has not been resolved within 30 working days from the date of complaint.
